Chapter 1: General Provisions
Article 1 (Purpose)
These Terms of Use ("Terms") govern the conditions and procedures for using all services ("Services") provided on the website ("Site") of Les Jardins de Médongaule ("Garden"), operated by Mdale Co., Ltd. ("Company"). The Terms also define the rights and obligations of users arising from membership registration, responsibilities, and other necessary matters.
Article 2 (Definitions)
- The definitions of terms used in these Terms are as follows:
1) Site: A website operated to provide ticket reservations and content related to the Garden.
2) User: Any individual accessing the Site and using the Services, including both members and non-members.
3) Member: An individual who has agreed to these Terms, registered by providing personal information, and is eligible to receive continuous access to information and Services provided by the Site.
4) Non-Member: An individual who uses the Services without registering as a Member.
5) Registration: The act of completing a Service use agreement by filling out the registration form and agreeing to these Terms.
6) Password: A combination of letters and numbers chosen by the User to protect personal information and verify identity.
7) Termination: The act of terminating membership by the Member. - Terms not defined herein shall be interpreted according to applicable laws and the policies established by the Site.
Article 3 (Effect and Modification of Terms)
- By agreeing to these Terms, Users acknowledge that these Terms shall take precedence regarding the use of the Site and the Services.
- The Company may amend these Terms without prior notice. Modified Terms shall be effective upon notice via the Site or email. Continued use of the Services shall constitute acceptance of the modified Terms. In the case of material changes, separate consent procedures may apply.
Article 4 (Governing Laws)
Any matters not stipulated in these Terms or interpretations thereof shall be governed by the Personal Information Protection Act, Telecommunications Business Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, and other applicable laws.
Article 5 (Membership Registration and Service Agreement)
- A service agreement is established when a User completes the registration form provided by the Site.
- The Company may cancel membership in the following cases:
1) Registration using another person’s name
2) Providing false information during Registration
3) Disrupting other Users’ use of Services or stealing information
4) Violating applicable laws or these Terms through use of the Site
5) Failure to meet the Company’s membership criteria - The Company may defer registration in the following cases:
1) Lack of Service capacity
2) Technical difficulties - The Site may require Users to verify identity via mobile or email authentication to prevent duplicate registration and ensure secure Service. In such cases, identity verification may be outsourced, and personal information used for verification will not be stored by the Site.
Article 6 (Contents of the Services)
- Members may access the following Services:
1) Reservation and payment for Services and content provided via the Site
2) Receipt of updates via email, SMS, or notification regarding Garden-related events, exhibitions, or educational programs (with prior consent)
3) Participation in special promotions, subject to eligibility and limitations as announced - The Company may add to or modify Services and notify Members accordingly.
Article 7 (Use and Restriction of Services)
- Services are generally available 24/7 unless prevented by maintenance, system failures, or other unavoidable reasons.
- In such cases of Service restriction, advance notice will be provided through the Site unless the interruption is caused by uncontrollable circumstances.
Article 8 (Member Obligations)
- Members must comply with these Terms, Site policies, and relevant laws, and must not interfere with operations or damage the reputation of the Garden.
- Members are solely responsible for managing their accounts, including ID and password.
- Any unauthorized use of an ID must be reported immediately.
- Members may not use the Services for business purposes without prior consent by the Company.
Article 9 (Membership Restrictions)
- Children under 14 years of age are not eligible to register.
- Minors aged 14 to 19 may require parental or legal guardian consent to register.
- Individuals whose membership was suspended or revoked under Article 10.3 may not re-register for up to one year without Company approval.
Article 10 (Membership Termination)
- Members may terminate their membership at any time via the “My Page” menu, and the Company shall promptly process the request in accordance with applicable laws.
- Upon termination, access to Services requiring login will be revoked.
- The Company may suspend or revoke membership without notice in the following cases, with the effect equivalent to termination:
1) Providing false information during registration
2) Committing crimes or engaging in inappropriate conduct within the Garden
3) Spreading false information about the Garden or the Company
4) Creating multiple accounts
5) Defaming or harming others or the Garden
6) Abusing ticket reservation system or various events and promotions
7) Damaging facilities or disturbing others within the Garden
8) Death of the Member
9) Any other conduct substantially impairing the Garden's operation - In such cases of Article 10.3, the Company may retain personal data for up to one year in accordance with its Privacy Policy.
Article 11 (Member Notifications)
- Notifications to Members may be sent via the email address registered upon sign-up.
- For general notifications to a large number of Members, posting on the Site bulletin board shall suffice.
Chapter 2: Ticket Reservation Services
Article 12 (Use of Reservation Services)
- The Company offers ticket reservation services through the Site. The availability period and payment methods (e.g., credit card) may vary by specific Service. Details regarding reservation are provided on the Site. The Company may announce changes via email or pop-ups, which become effective immediately upon notice.
- Members may view their reservation history through the “My Page” section on the Site.
Chapter 3: Miscellaneous
Article 13 (Personal Information Protection)
The Company’s Privacy Policy posted on the Site shall apply regarding management of personal data.
Article 14 (Copyright and Restrictions on Use)
- Copyright for content posted on the Site belongs exclusively to the Company.
- Users may not reproduce, transmit, publish, distribute, or broadcast any information obtained through the Site for commercial purposes without prior written consent from the Company.
Article 15 (Limitation of Liability)
- The Company shall not be liable for damages unless caused by intentional or gross negligence.
- The Company has no obligation to verify or endorse information or opinions posted on the Site.
- The Company is not liable for damages caused by the User's own fault.
- The Company does not guarantee any benefits expected by Members from using the Services.
- The Company is not involved in disputes between Users or between Users and third parties and assumes no liability for such disputes.
- The Company is not liable for service interruptions or data loss caused by force majeure.
Article 16 (Jurisdiction)
Any disputes arising in connection with the Services shall be resolved under applicable laws, and the exclusive jurisdiction shall lie with the Seoul Central District Court.
[Supplementary Provisions]
1. These Terms shall be effective as of May 7, 2025.
2. These Terms shall take effect upon a User’s registration as a Member.
